Prism Travel Terms of Service
Registration and Payment
In order to be considered for a specific trip you must apply (through our application process). If you are approved you will receive an email notification (stating such approval) and a link to finalize further necessary information and payment. After receiving trip approval you will have 3 business days to submit the necessary information and submit a deposit (or payment in full, depending on time frame per below) to secure your spot.
If you have reserved a spot via a deposit transaction, full payment is due on a date specified in the Trip Details unique to each trip. If full payment is not made by this time we reserve the right to retain any deposits made and release your spot to someone else. We accept payment via credit card and debit card.
In order to reserve your spot on the trip, a non-refundable $200 deposit is required. Until this deposit is made your spot on the trip is not guaranteed. If Prism Travel, for whatever reason, cancels the trip the deposit will be refunded. If you cancel your trip after putting down a deposit we reserve the right to not refund the deposit.
By the traveler:
If you cancel your booking cancellation fees could apply. A cancellation will only be effective when we receive written confirmation of the cancellation. If you cancel a trip:
- Prior to the payment due date you will receive a full refund less deposit amount
- After the payment due date but more than 30 days prior to departure we will retain the deposit and 50% of the amount paid
- Less than 30 days prior to departure we retain the right to not refund any of the costs paid
By Prism Travel:
We may cancel a trip at any time up to 30 days before departure, if, for example, the minimum number of participants required for departure isn’t satisfied. To find out the minimum number of participants required please contact Prism Travel (email@example.com) to inquire. You may also inquire as to the number of participants currently enrolled in a particular trip by emailing at any at time. We also may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary. If we cancel your trip you will receive a full refund. In circumstances where the cancellation is due to external events outside our reasonable control refunds will be less any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.
Travel insurance is not required but strongly recommended. If you obtain travel insurance we recommend a minimum coverage of $200,000 covering personal injury, medical expenses, loss of or damage to luggage, repatriation expenses, and evacuation expenses.
Passports and Visas
Valid passports are required for travel to all international destinations. The traveler is responsible to ensure his/her passport is valid for at least 6 months after the departure date of the trip. Check with the appropriate consulate or embassy for the latest visa requirements.
Prices are based on current rates of exchange, tariffs and taxes. Prism Travel reserves the right to increase tour prices to cover increased costs, tariffs and taxes, and to reflect fluctuations in foreign exchange markets. Prism Travel also reserves the right to withdraw activities or make such alterations in the itinerary or with the tour inclusions as it deems necessary or desirable and to pass on to tour members any expenditures or losses caused by delays or events beyond its control. Itineraries and arranged sightseeing are subject to change at any time due to unforeseen circumstances or circumstances beyond Prism Travel’s control. Every effort will be made to operate tours as planned, but alterations may occur after the final itinerary has been issued.
The purchases made through Prism Travel do not include incidental expenses, except as specifically described in your itinerary, and you are liable for all such incidental expenses that you incur during, or in anticipation of, your purchased product and/or service. These things may include but are not limited to: airfare to the destination, meals, incidental expenses, alcohol, and any entrance or departure fees into the destination country.
Claims and Refunds
Refunds are not made for any services missed by the traveler, except for verifiable extenuating circumstances. Please see our Limits on Responsibility on this page. For verifiable claims to be considered, they must be received in writing within 30 days of the trip’s completion and be accompanied by supporting documentation and/or a statement from the Operating Company verifying the claim. Any adjustment considered will be based on the actual price of the services involved and not on a per diem basis. Adjustments will not be made for unused sightseeing trips or meals. Prism Travel will not consider nor accept any liability for any claims that are not received within 30 days of the termination of your travel program. All claims for days missed while travelling should be made in writing within 30 days of the termination of the program.
Prism Travel will not accept any responsibility for mistakes or errors in airfare bookings made by the traveler or independent third parties. The traveler is responsible for booking his/her own flights for arrival and departure based on the flight instructions provided by Prism Travel.
Authority on Tours
Our group trips are run by a local group leader. The decision of the group leader is final on all matters likely to affect the safety or well-being of any person participating in the trip. If you fail to comply with a decision made by a group leader, or interfere with the well-being or mobility of the group, the group leader may direct you to leave the trip immediately, with no right of refund. We may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited. Further, your trip will travel between cities on various modes of transportation; if you are not present at the aforementioned time (for said transportation) your group leader reserves the right to carry on without you so as not to divert from the predetermined itinerary. If this is the case we are not responsible for any additional transportation costs that may arise. We are not responsible for your health, safety, well being, or any other liabilities during this time in which you are “separated from the group” on your own recognizance. Lastly, you are never obliged to participate in any activity which you wish not to for whatever reason.
Changes to Itineraries
Prism Travel reserves the right to cancel, delay, or reschedule any tour prior to departure, and, so long as this is not due to any causes beyond our control (as stated in the Limits on Responsibility section) the passenger shall be entitled to a full refund of all monies paid to that point if he/she so desires, less any non-refundable deposits or uncollectible expenses incurred. If we do change the itinerary, and you are already booked for that particular trip, we will notify you of the changes. If you are not pleased with the changes you may receive a full refund provided you request a refund 2 business days after receiving a notice of change to your trip itinerary from Prism Travel.
Limits on Responsibility
Prism Travel, its employees, officers, directors, successors, agents and assigns, does not own or operate any entity which is to or does provide goods or services for your trip. It purchases transportation (by aircraft, coach, train, vessel or otherwise), hotel and other lodging accommodations, restaurant, ground handling and other services from various independent suppliers (including from time to time other affiliated Prism Travel companies). All such persons and entities are independent contractors. As a result Prism Travel is not liable for any negligent or willful act of any such person or entity or of any third person.
Prism Travel, acts solely as agents for the client with respect to all transportation, hotel and other tour arrangements. In that capacity, Prism Travel exercises all reasonable care possible to ensure the traveler’s safety and satisfaction, but, Prism Travel neither assumes nor bears any responsibility or liability for any injury, death, damage, loss, accident, delay, or irregularity arising in connection with the services of any airplane, train, ship, automobile, motor coach, carriage, or other conveyance, or the actions of any third-party involved in carrying the traveler or in affecting these tours. Prism Travel is not responsible for damages, additional expenses, or any other losses due to cancellation, delay or other changes in air or other services, sickness, weather, strike, war, civil disturbances, acts or threats of terrorism, travel warnings or bans, termination or suspension of war risks or other carrier insurance, quarantine, acts of God or other causes beyond its control. All such losses must be borne by the traveler, and tour rates provide for arrangements only for the time stated. Prism Travel is not responsible for delays, changes or cancellation costs due to incorrect, incomplete or expired traveler documents. In the event of cancellation, delay or rescheduling mandated by any of the aforesaid causes beyond Prism Travel’s control, the passenger shall have the option of accepting in lieu of the original tour such rescheduled tour or other substituted tour(s) as may be offered, or else, receiving a refund of as much of such advance tour expenditures as Prism Travel can recover on the traveler’s behalf from carriers, third-party tour vendors, etc., but, Prism Travel shall not have any obligation or liability to the traveler beyond the foregoing. Prism Travel reserves the right to make alterations to a tour’s itinerary and to substitute hotels, vehicles, ships, or activities if this is required.
In addition and without limitation, Prism Travel is not responsible for any injury, loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or force majeure, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time.
Risks: There are certain inherent risks in adventure travel of the type involved here. These include, but are not limited to, hiking, walking, climbing injuries and altitude sickness, and in all trips dangers of animals, inaccessibility to medical attention and difficulty in evacuation from remote locations in the case of a medical emergency. Passenger assumes all such risks with regard to these possibilities.
Travel Advisories/Warnings: It is the responsibility of the traveler to become informed about the most current travel advisories and warnings by referring to the U. S. State Department’s travel website at www.travel.state.gov/ or by phone at 1-888-407- 4747. In the event of an active State Department Travel Warning against travel to the specific destination location(s) of the trip, should the traveler still choose to travel, notwithstanding any travel advisory or warning, the traveler assumes all risk of personal injury, death or property damage that may arise out of the events like those advised or warned against.
Travelers Representations: The Traveler represents that neither he nor she nor anyone traveling with him or her has any physical or other condition or disability that could create a hazard to himself or herself or other members of the tour. Prism Travel reserves the right to decline to accept anyone on a trip. Prism Travel reserves the right to remove from the trip, at his or her sole expense, anyone whose condition is such that he or she could create a hazard to himself or others, or otherwise impact the enjoyment of other passengers on the trip.
The Prism Terms of Service is a legal agreement between you and Prism Travel that governs your interaction on PrismTravel.club and on Prism Travel trips and your purchases and use of products and services made available through the Site. By using the site, you signify that you have read, understand and agree to be bound by all of these terms. We have the right to change the terms at any time without notice, effective upon its posting to our Prism Travel website. Your continued use of Prism Travel shall be considered your acceptance to the revised Terms.
PAYMENT OF THE TRIP PRICE CONSTITUTES YOUR ACCEPTANCE OF THE TERMS AND CONDITIONS SET OUT HEREIN
